Once in your hand, it is being used. The offence is complete. Remember the phone 'pings' every so often so is still transmitting and receiving data without you knowing about it. Yes, you are wonderful and always secure a NG verdict, but most people will not achieve that. The police did not even bother to send NIPs to the other possible drivers. The CPS continued to prosecute him and we went to trial yesterday. The police responded by sending? a photo (no use) and asked him to supply the 4 names. He wrote back giving the names, addresses and dates of birth for each possible driver. He did everything possible to ID the driver and explained everything fully to the police. He did exactly what the police advised him to do.
